Common Questions
Will a prenup hold up in court?
Yes, if properly executed. Florida requires both parties to make full disclosure, sign voluntarily without duress, and the agreement must not be unconscionable. We ensure all requirements are met.
Should my fiancé(e) have their own attorney?
We strongly recommend it. While not required, having independent counsel for both parties strengthens the agreement and reduces the chance of future challenges.
When should we do this?
At least 30 days before the wedding is ideal. Agreements signed under time pressure may be challenged as signed under duress.
Can we protect future inheritance?
Yes. Prenups can specify that future inheritances remain separate property, protecting family wealth for generations.
